Former Ekiti State governor, Otunba Ayo Fayose, on Wednesday urged the Federal High Court in Ado Ekiti to quash the Economic and Financial Crimes Commission, (EFCC) corruption charges against him.
Fayose’s counsel, Mr Owoseni Ajayi, made the application when the matter came up for hearing before Justice Adamu Hobon.
Ajayi argued that the charge “is legally offensive to criminal procedure and will waste the precious time of the court’’.
He argued that the Criminal Code states that a criminal charge brought against anyone must be specific in particulars, claiming that the “matter in this case is not specific and it is nebulous’’.
The EFCC, however, opposed the application, arguing that the commission had filed a counter-affidavit challenging the application, and had established a prima facie case against the accused.
EFCC counsel, Mr Adebisi Adeyemi, said the application brought by the applicant lacked merit and a ploy to frustrate the case and waste the time of the court.
Adeyemi urged the court to dismiss the application, saying: “we have established that there is a prima facie case and we have sufficient evidence to prove our case’’.
Both counsel adopted their written addresses to support their applications.
Hobon adjourned the case to November 7 for ruling.
