The Federal High Court in Abuja has granted Justice Mark, popularly known as Justice Crack, bail of N5 million with a surety of equal amount in his ongoing trial over alleged cybercrime offenses.
Justice Joyce Abdulmalik ruled that the surety must reside within the court’s jurisdiction for at least four years and provide proof of residence, such as a tenancy agreement or certificate of occupancy. The surety is required to be a federal civil servant at Grade Level 15 or above, with evidence of three months’ salary, pensionable employment, a letter of authentication from their department, a recent passport photograph, and a sworn affidavit of means.
The court also directed that Justice Crack deposit his international passport with the court registry.
During proceedings, the prosecution, led by M.L. Jackson, called Douglas Uruntu, a Department of State Services (DSS) operative, as the first witness. Uruntu explained that he met the defendant while investigating after he was transferred from the Nigerian Army Intelligence Corps.
The witness said Justice Crack voluntarily made an extra-judicial statement in the presence of his lawyers. According to him, the defendant allegedly created and circulated videos on social media from images provided by soldiers without verifying their authenticity. Investigators later extracted data, including videos, chats with soldiers, and social media content, from the defendant’s devices. A certificate of compliance was issued by a superior officer after forensic analysis.
The defense counsel, Sam Amadi, raised objections regarding non-receipt of certain investigation documents. The prosecution acknowledged the oversight and apologized. Subsequently, the court admitted the DSS investigation report as Exhibit A, along with an iPhone and flash drive allegedly recovered from the defendant, containing social media videos and communications. Amadi objected to the flash drive’s admissibility, noting its contents were not demonstrated in court.
The trial has been adjourned to May 25, 2026, for continuation.
Justice Crack faces charges under FHC/ABJ/CR/253/2026, accused of circulating false information capable of causing public unrest, including claims about inadequate feeding of Nigerian soldiers via his X handle, @JusticeCrack.
