Okada ban: Lagos court to rule on Wednesday

Osun Govt gives two-week ultimatum to Okada riders for registration or risk suspension

Justice Mohammed Liman of the Federal High Court has fixed Wednesday to rule on whether or not the banning of commercial Okada riders on some Lagos roads is in tandem with the law.

The adjournment by the court to rule on the preliminary objection by the Lagos State government was after the parties were heard by the presiding judge.

The Lagos State Government has argued before the court that the decision to ban the use of Motorcycle and Tricycles was not in anyway in breach of the fundamental rights of the riders in Lagos State.

The government, through an executive order, banned the use of Motorcycle and Tricycles in six Local Government Councils and nine LCDAs, which generated reactions from the riders as well as some Lagosians, who argued that the government’s decision will lead to unemployment.

A lawyer, Olukoya Ogungbeje, had filed a Fundamental Human Rights’ application on behalf of some riders before the Federal High Court, Ikoyi seeking to challenge the executive order of Governor Babajide Sanwo- Olu, restricting the use of motorcycles and tricycles in 6 Local Government Councils and 9 LCDAs.

The Lagos State through the office of the Attorney-General and Commissioner for Justice, Mr. Moyosore Onigbanjo SAN, filed a notice of preliminary objection and counter affidavit.

The Attorney-General, who appeared for the State Government before the Court, added that the State Government has also filed written address in opposition to the originating summons of the applicant.

Urging the court to dismiss the originating summons, the state stated that the restriction of Motorcycles and Tricycles on major roads in the State is in line with the provisions of the Transport Sector Reform Law of Lagos State, 2018.
