Surety in trouble as accused jumps bail

A Kubwa Upper Area Court in the FCT, Abuja on Friday revoked the bail granted an accused, Emeka Nwebelu, for failure to appear in court after several adjournments.

Revoking the bail, the Presiding Officer, Malam Munir Lawal, ordered for the re-arrest of the accused, who should be remanded in prison.

Lawal said: “The accused person’s bail is hereby revoked and he should be arrested and kept in prison custody.

“As for the surety, court gives him benefit of doubt. He should cooperate with police to find the accused; failure to do this, he will forfeit his bail bond.’’

The police had arraigned the surety, Mr Julius Amadi, for his inability to produce the accused in court.

Police prosecutor Egusigo Charles had told the court that since the accused was admitted on bail, he (Nwebelu) had failed to appear in court and his surety had claimed ignorance of his whereabouts.

He prayed the court to disregard a medical report tendered by Amadi because it had no date and official stamp.

“I urge the court to issue a bench warrant for the surety to forfeit his bail bond and be kept in prison custody until the accused is re-arrested,’’ Charles said.

Amadi had tendered Nwebelu’s medical report, which states that the accused was hospitalised at the Lafia General Hospital in Nasarawa State.

Nwebelu was arraigned before the court on Jan. 21, for criminal intimidation contrary to Section 397 of the Penal Code.

The accused had pleaded not guilty to the charge.

Lawal granted the accused bail in the sum of N100,000 with one surety in like sum and adjourned the case to Feb. 7 for hearing.

Court records shows that the accused had not appeared in court since he was released on bail on Jan. 21.
