An Ikeja Magistrates’ Court on Wednesday struck out a case of alleged N4 million fraud following the death of the accused, Kingsley Ihiegbule.
Ihiegbule was reported to have died in December, 2015, during a brief illness.
The prosecutor, Inspector Victor Eruada, presented to the court, obituary poster, photo of corpse, death certificate, among others, as evidence of the passage of the accused.
At that, the Magistrate, Mrs F.A. Azeez, ruled that “the case can no longer continue as the court cannot prosecute the accused in the grave.
“The case is hereby struck out.”
Ihiegbuleu, 49, who was resident at 5, Ibrahim Moradejo St., Ejigbo, Lagos, was arraigned on June 4, 2014 on a two-count charge of fraud and stealing.
The prosecutor had told the court that the accused fraudulently converted N4 million, property of Afrab Chem Ltd., to his own use.
He said that the accused committed the offences in October, 2013, at Mushin, Lagos.
He said that the offences contravened Sections 285 and 312 of the Criminal Law of Lagos State, 2011.
The accused pleaded not guilty to the charges and was granted bail in the sum of N500, 000 with two sureties in like sum.
