Court orders Bianca to re-open her evidence in Ojukwu family case

A Lagos High Court in Igbosere has granted the prayer of Bianca Ojukwu, wife of late Dim Chukwuemeka Odumegwu-Ojukwu, to re-open her evidence-in-chief in her suit against her husband’s family.
Bianca had dragged Ojukwu Transport Ltd (OTL) and seven others before the court for alleged move by the family to eject her sons from the company’s properties located in Lagos.

She filed the suit on behalf of her two under-age children, Afamefuna and Nwachukwu.

The other defendants in the suit are Prof. Joseph Ojukwu, Mr Emmanuel Ojukwu, Lotanna Ojukwu, Dr Patrick Ojukwu, Mr Edward Ojukwu, Akajiora Ojukwu and Mrs Massey Udegbe, doing business under Massey Udegbe & Co.

Bianca, who had earlier testified before the court, had filled two separate applications.

She sought the leave of the court to allow her amend her writs of summon, statement of claims and to re-open her evidence-in-chief.

All the respondents in the suit, however, did not oppose the applications.

Justice Abdulfattah Lawal consequently granted all the applicant’s prayers and ordered her to re-open her evidence-in-chief on June 3.
Bianca had told the court that she was the only legally married wife among Ojukwu’s wives because her court, church and traditional marriages were performed.
She had also informed the court that some of the OTL properties in question had been in the possession of her late husband before his demise.
Bianca also said that the rents of the properties were collected by her husband.
In the suit, Bianca and her two children had in their statement of claim, prayed the court to declare that the threat of forceful ejection from 29, Oyinkan Abayomi Street, Lagos, by the defendants was illegal.
She is also asking the court for a declaration that her children are entitled to possess the properties at No. 13, Hawksworth Road, Ikoyi, Lagos, now known as No. 13, Ojora Road.
Others properties include No. 32A, Commercial Avenue, Yaba, Lagos, No. 30, Gerard Road, Ikoyi, Lagos, and No. 30 McPherson Avenue, Ikoyi, Lagos.
