NBA election: Court grants Gadzama’s application, adjourns hearing till Sept 8

An FCT High Court on Thursday granted Mr Joe-Kyari Gadzama’s request to serve Grace Infotech Limited an ex-parte order of service to appear in court.

Gadzama (SAN) had earlier filed a suit challenging the election of Mr Abubakar Mahmoud (SAN) as president of the Nigeria Bar Association (NBA).

The election was held on July 30 and July 31.

He said the election fall short of established standards and international best practice, thereby making it “null and void and of no effect whatsoever’’.

Gadzama said in his originating summons that the internet voting mechanism was not in conformity with the mandatory provisions of the NBA constitution, 2015.

Grace infortech Limited was the company that provided facilities for the NBA election and the 13th defendant in the matter.

Gadzama, in his statement of claims, asked the court to nullify and set aside the election.

Justice Olukayode Adeniyi, the presiding judge granted the application at the resumed hearing of the matter.

“In the overall interest of justice, according to order 46 rule 1 and the inherent law of this court, I hereby grant this application according to the prayers in the originating summons to serve Grace Infotech Limited motion on notice.’’

Adeniyi ordered that the notice be pasted at the entrance of the company’s office in Wuse 2, Abuja and adjourned hearing in the matter until Sept. 8.

He equally urged the parties to file and respond to motions within the stipulated time to accelerate hearing in the matter.

Earlier, Counsel to Gadzama, Mr Nnaemeka Ngige (SAN) said that serving Grace Infotech Limited had been difficult as the office was always under lock and key.

Mr Paul Erokoro, (SAN) Counsel to Mahmoud, said that they intended to rely on the information of Grace Infotech Limited in the matter since Gadzama stated that the election was not properly conducted.
