After five years in detention, court acquits four armed robbery suspects

Five years and three months after languishing in prison custody, an Oyo High Court 1 has discharged and acquitted four armed robbery suspects.
The suspects, Amuda Jimoh, Salihu Jimoh, Ibrahim Jimoh, and Suleiman Idrisu, are aged between 21 and 24 years.
The three Jimohs are from same parents.
They were arraigned before Justice O. Olatunji of an Oyo High Court 1 by Oyo/Ogbomoso annexe of the Federal Special Anti-Robbery Squad for robbery at Ilora, in Afijio Local Government Area.
The three suspects’ parents died in the course of the case in court.
At the hearing, the prosecution counsel, Mr. K.A. Babalola, a
Principal State Counsel, called only one witness, who tendered statements of the accused persons.
But in the objection of the counsel for the accused persons, Olawale Omoloye, statements of the suspects were rejected by the court because they were not admissible in law.
Upon the closure of the prosecution case, counsel to the accused persons put in a no-case answer submission and same was upheld by the court upon which the four robbery suspects were discharged and acquitted.
Happiness knew no bounds for the suspects and their relations who openly shed tears of joy.
After the judgement, Omoloye said: “There are no two ways to the duty imposed on the imposition on the prosecution to establish the essential ingredients of robbery beyond
reasonable doubts. The judgement further buttressed that issue of law.”
Omoloye, who further noted that the accused persons were
freed with the grace of God and in line with the prescription of the law, said after the judgement, there is still God’s judgement therein.
According to him: “ I called upon the accused persons now freed and other youths in the country whose stocks in trade are undesirable behaviours, to forthwith refrain from any criminal act, but be closer to God, seek His divine guidance, so as to live fulfilled lives”.
